Sound Off: Supreme Court to Consider Same-Sex Marriage Case Friday

The U.S. Supreme Court is slated to decide whether to hear an appeals case that would determine the legality of same-sex marriage in California. What do you think it should do?

After years of legal wrangling, the U.S. Supreme Court could decide Friday if same-sex marriage is legal in California.

The court will convene to decide whether to hear a case challenging Proposition 8, the amendment banning gay marriage in California. In February, the 9th Circuit Court of Appeals ruled the amendment unconstitutional, and Propostion 8 proponents appealed the ruling.

If the Supreme Court chooses not to hear the appeal, then the circuit court ruling would stand, and gay marriage could, once again, be legal in California. If the nation’s top court does take up the case, Californians would likely have to wait several months before a decision is made.

According to the court panel's ruling, the proposition's primary impact was to "lessen the status and human dignity of gays and lesbians in California."

"It stripped same-sex couples of the ability they previously possessed to obtain and use the designation of `marriage' to describe their relationships," according to the court's decision. "Nothing more, nothing less. Proposition 8 therefore could not have been enacted to advance California's interests in child-rearing or responsible procreation, for it had no effect on the rights of same-sex couples to raise children or on the procreative practices of other couples.

"Nor did Proposition 8 have any effect on religious freedom or on parents' rights to control their children's education; it could not have been enacted to safeguard those liberties."

Opponents of same-sex marriage were equally strong in their words condemning the ruling at the time.

Proposition 8 supporter Randy Thomasson, president of SaveCalifornia.com, blasted the ruling, calling it "unfair to the voters, against our republic, against our democratic system..."

"It's illogical and unconstitutional to claim that natural, unchangeable race and ethnicity is the same as sexual behavior,'' he said after the ruling. ``That's not fair or true. Race and ethnicity are inherited, but science has never found homosexuality, bisexuality or transsexuality to be inherited or unchangeable.''

This should absolutely be passed. I know many gay couples and they even have children. It is time for equal rights for everyone kicks in in California We know who wrote prop 8 so people would vote against gay marriage & rights. The prop was framed to confuse people ( and people are cofused when voting on props unless they study them & see who is for and who is against). This is a social wedge issue that very right wing, conservative, religious people want stopped. California has always led good reforms, but this time the stew was spoiled by those who cling to old fashioned ideologies!!

The courts are out of control and out of jurisdiction. Nothing in our Constitution, federal or state, says anything about marriage. This is a voter issue and has already been decided at the polls. But hey, Democracy is dead in America, and add to that California has already shown itself to be the most poorly governed state in the Union, (#50) so this will be just more downward spiral of the whatever floats your boat mentality that pervades in the USA today. To suggest that morality is out of date plays right along with Harvard's new kinky sex club, no doubt subsidized by tax dollar somewhere along the line. Nothing surprises me any more, but I would be delighted to see the court put this issue back to the voters where it belongs.

Why should we need to vote on a ever evolving country and state. Didn't my older syblings burn thier bras in the sixties and others rebell against being ignorant. years ago ? WOW ! nothing like going back in time !!!! It dosen't matter which wing your on....but religous....well religeon is base on fear and power over with the sense of concure and devide.....seems we can never sepperate church and state in this fast moving ever forward country of ours that seems to have issues with being out of the box thinkers, other than how to takeof the world !

"Morality" -or rather YOUR definition of it-has nothing to do with it. How many heterosexuals marry and then have affairs? Get divorced a short time after getting married? Does that sound "moral" to you? How about have a homosexual affair and then claim the devil made them? People certainly don't choose to be gay. They don't choose to be maligned, ostracized, spit at, called names, or beaten. People are born gay. Love is love, regardless of if you fall in love with a man or a woman and what your own gender is. It's not YOUR job to judge if the person is wrong. Leave it to God.

No group should be able to deny rights to another group. Don't see any way the court could legitimately uphold Prop. 8.

God, as our Creator, defines what marriage is... Not mankind... We need to listen to Him because He is love and wants only what is best for us... We wonder why we have the litney of problems that plague our society... Whether we try and redefine who He truly is, or distant ourselves from His council, we our leading ourselves down a path which will lead to our destruction...
Ultimately, our decisions to go against our Creator's will in many areas will bring His judgment upon us... He has not changed, and neither has human nature.. These decisions have been made many times in the past, and have lead to the demise of nations... There is joy in serving God according to His Word... He is willing to forgive any sin... For His mercy is greater than sin... God bless, and seek to please the One who gave us life... Who wants us to live it abundantly... We are on His earth, and we must abide by His rules...

Thank God in this country, unlike many others, we have freedom of religion AND separation of church and state. Equal rights must be given to ALL people.

It would be best if the court didn't hear the case. If they do it will cause all kinds of strife. In the end they will have to rule prop 8 is unconstitutional. To rule otherwise would show them to be a political entity instead of a judicial one.

You can get everything from 100 packs of #2 pencils to college ruled notebooks and binders, to pens and highlighters. We go there weekly and send boxes of school supplies, crayons and coloring books to our troops in Afghanistan to help them befriend the locals. The biggest score is cans of party string that usually go for $5. They spray it into a room and the streamers will hang on any tripwires without setting off the bomb. And try asking the store manager if corporate might be willing to throw in 2 for the price of one or a bakers dozen on highly stocked items if you can get several other teaches to also shop there. It never hurts to ask.

I have shopped at Staples for years and have yet gotten a so-called reward. Why the change of heartRead More now? The school supplies are overpriced anyway. I get things really inexpensively at Walmart right before school starts. There is no limit as to how many things one can buy like there is at Staples.
